EMERGE's policies and procedures for handling customer information have been created with the understanding that Internet technologies are still evolving and that Internet business methods are continuing to evolve to meet the needs and opportunities of the changing technologies. As a result, EMERGE's policies and procedures are subject to change.

In the course of serving its customers, EMERGE acquires, stores and transmits customer communications and information that customers may regard as private or sensitive. Some of this information - such as the customer's name, address, telephone number, and credit card data - is provided to EMERGE by its customers in order to establish service. Other information - such as the customer's account status, choice of services, and customer logs - is created and maintained by EMERGE in the normal course of providing service. EMERGE also uses cookies, which are small pieces of information that a web site can store in a designated file on a user's computer for various reasons. For example, EMERGE uses cookies on the landing pages of products sold online which record the customer information that is required on the order form. This information is then forwarded to an internal sales tracking database within EMERGE. In addition, EMERGE may store customers' electronic mail and other communications as a necessary incident to the transmission and delivery of those communications.
 
Data Security
EMERGE will protect the confidentiality of its customers' information, account information and personal communications to the fullest extent possible and consistent with the law and the legitimate interests of EMERGE, its partners, its employees and other customers of EMERGE's services. To protect the loss, misuse, and alteration of information that is collected from customers, EMERGE has appropriate physical, electronic, and managerial procedures in place.
 
Disclosure of customer information and communications
Buypix is a service that allows members of Buypix purchase and sell stock photography via the Internet. Please keep in mind that if you disclose personal information in your profile or when posting comments, messages, photos, videos, music or other items, this information may become publicly available.

Although we have security settings that provides user authentication before accessing your Buypix account information, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users or public visitors with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that contents or information that you post via Buypix will not be viewed by unauthorised persons. We are not responsible for circumvention of any privacy settings or security measures contained on Buypix and EMERGE’s servers. You understand and acknowledge that, even after removal, copies of contents and information may remain viewable in cached and archived pages or if other Users or public visitors have copied or stored your contents and information.

EMERGE does not provide contact information to third party marketers without your permission. We share your information with third parties only in limited circumstances where we believe such sharing is 1) reasonably necessary to offer the services of Buypix, 2) legally required or, 3) permitted by you. For example:
  • Buypix displays certain member information on Internet such as pictures, personal website address, membership start date. This will allow public to access the member’s personal website which may you may choose to display your personal information.

  • We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. Additionally, we may share account or other information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the Buypix service or using the Buypix or EMERGE name, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.

  • EMERGE has reason to believe that disclosing such information is necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of EMERGE, EMERGE's customers, or others, or where EMERGE has a good faith belief that the law requires such disclosure.

  • If the ownership of all or substantially all of the Buypix services, EMERGE business, or individual business units owned by EMERGE, were to change, your user information may be transferred to the new owner so the service can continue operations. In any such transfer of information, your user information would remain subject to the promises made in any pre-existing Privacy Policy.

  • EMERGE may work with external parties to provide certain functionalities within Buypix. In such event, we may share necessary user information with that company in connection to providing the functionalities to you.
EMERGE also will not, except for reasons stated below, disclose to third parties the contents of any electronic mail or other electronic communications that EMERGE stores or transmits for its customers. The circumstances under which EMERGE will disclose such electronic customer communications are when:
  • it is necessary in order to provide service to the customer;

  • it is necessary to protect the legitimate interests of EMERGE and its customers;

  • it is required to cooperate with interception orders, warrants, or other legal process that EMERGE determines in its sole discretion to be valid and enforceable; and

  • it is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by EMERGE and appear to pertain to the commission of a crime.
Links To Other Websites
Buypix website may contain links to other websites, including links that are provided by Buypix users on their website. We are not responsible for the privacy practices of other web sites. We encourage our customers to be aware when they leave our site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by EMERGE and the Buypix services.
 
Changes To Privacy Policy
Although we may attempt to notify you when major changes are made to these Privacy Policy, you should periodically review the most up-to-date version at www.buypix.ximplify.com/include/policy.asp EMERGE may, in its sole discretion, modify or revise the Privacy Policy and other policies at any time, and you agree to be bound by such modifications or revisions.

EMERGE disclaims any intention to censor, edit or engage in ongoing review or surveillance of communications stored on or transmitted through its facilities by customers or others. EMERGE will, however, review, delete or block access to communications that may harm EMERGE, its customers or third parties. The grounds on which EMERGE may take such action include, but are not limited to, actual or potential violations the Buypix Terms Of Use, Membership Agreement, Content Upload Agreement and Content License Agreement.
